06

Lawful bases for processing

UK data-protection law requires a lawful basis for each use of personal information. Cape Wired may rely on the following bases.

Lawful basis When it may apply
Contract Where processing is necessary to take steps at your request before entering a contract or to perform an agreed client or supplier contract.
Legitimate interests Where processing is reasonably necessary to operate and develop Cape Wired, respond to business enquiries, maintain client relationships, secure systems, improve services or establish and defend legal rights, provided those interests are not overridden by your rights.
Consent Where you have made a clear choice, including certain marketing communications and non-essential cookies. Consent may be withdrawn at any time.
Legal obligation Where information must be retained or disclosed to comply with tax, accounting, court, regulatory or other legal requirements.
Legal claims Where processing is necessary to establish, exercise or defend legal rights and claims.

Where Cape Wired relies on legitimate interests, the nature of the processing, its necessity and its likely effect on individuals are considered before that basis is used.

07

Marketing communications

Cape Wired may send marketing or service-related communications where you have requested them, consented to receive them or where another lawful route is available for appropriate business communications.

Marketing messages may include information about:

  • Shopify, ecommerce SEO and GEO services;
  • new articles, case studies or business resources;
  • relevant service updates or events;
  • related offerings likely to be useful to an existing client.

You may stop direct-marketing communications at any time by:

  • using the unsubscribe link in an email;
  • replying to the message with your request;
  • emailing contact@capewired.com.

Opting out of marketing will not prevent Cape Wired from sending necessary service, contractual, account or legal communications.

08

Cookies, analytics and similar technologies

The Cape Wired website may use cookies and similar technologies to operate essential website functions, remember choices, understand website usage and measure performance.

These technologies may collect information such as:

  • IP address and approximate location;
  • browser, device and operating-system information;
  • referring website or campaign;
  • pages viewed and time spent on the site;
  • button, form and navigation interactions;
  • cookie-consent preferences.

Strictly necessary cookies may be used without optional consent because they are required for the website to function. Where required, analytics, advertising or other non-essential technologies should only be activated after you have made the relevant choice through the cookie-consent tool.

More information about the specific technologies used, their purposes and durations should be provided in the Cape Wired Cookie Policy.

Managing your preferences

You can use the website’s cookie controls to accept, reject or revise optional-cookie choices. You can also restrict cookies through your browser, although this may affect website functionality.

09

Who personal information may be shared with

Cape Wired does not sell personal information. Information may be shared where necessary with carefully selected recipients, including:

  • website-hosting, security and technical-support providers;
  • email, calendar, file-storage and collaboration providers;
  • analytics, consent-management and website-performance providers;
  • customer-relationship, project-management and communication tools;
  • payment, banking, invoicing and accounting providers;
  • subcontractors or specialists working on an agreed project;
  • professional advisers such as accountants, insurers and legal advisers;
  • public authorities, regulators, courts or law-enforcement bodies;
  • a prospective buyer or successor if Cape Wired or relevant assets are sold or reorganised.

Service providers are only permitted to use personal information for agreed purposes and are expected to protect it appropriately. Where Cape Wired introduces a client directly to an independent provider, that provider may become a separate controller and its own privacy notice will apply.

Personal information may also be disclosed where Cape Wired reasonably believes this is necessary to protect rights, investigate misuse, respond to a legal claim or comply with law.

10

International transfers

Some technology and service providers may process information outside the United Kingdom. This may include countries that do not provide the same level of statutory data protection as the UK.

Where an international transfer is legally restricted, Cape Wired will seek to ensure an appropriate safeguard applies. This may include:

  • a UK adequacy regulation;
  • the UK International Data Transfer Agreement;
  • the UK Addendum to approved standard contractual clauses;
  • another legally recognised transfer safeguard;
  • a permitted legal exception in limited circumstances.

You may contact Cape Wired for further information about the safeguards relevant to your information.

11

How long personal information is retained

Information is retained only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting, security and dispute-resolution requirements.

Information Indicative retention approach
General enquiries Normally retained for up to 24 months after the last meaningful communication, unless the enquiry develops into a client relationship or there is another reason to retain it.
Unsuccessful proposals Normally retained for up to 24 months to manage follow-up, understand prior discussions and respond to related queries.
Client contracts and project records Normally retained for the client relationship and for up to six years afterwards where required for contractual, professional, insurance or legal purposes.
Invoices and accounting records Normally retained for at least six years or for another period required by applicable tax and accounting law.
Marketing records Retained while you remain subscribed. A limited suppression record may be retained after an opt-out to ensure the request continues to be respected.
Website analytics Retained according to the configuration of the relevant analytics and consent tools, as described in the Cookie Policy.
Security and technical logs Retained for a limited period appropriate to system security, troubleshooting, fraud prevention and incident investigation.
Client-system access Removed or returned when no longer required for the project, subject to reasonable backup and audit processes.

Retention periods may be extended where information is required for an active dispute, legal claim, regulatory enquiry, fraud investigation or another legitimate reason. Information may be anonymised where continued statistical or analytical use does not require identification.

12

How personal information is protected

Cape Wired uses proportionate technical and organisational measures intended to protect personal information against unauthorised access, alteration, disclosure, loss or destruction.

Measures may include:

  • password management and multi-factor authentication;
  • restricted user permissions and delegated platform access;
  • encrypted connections and reputable cloud services;
  • software, plugin and security updates;
  • device and account-security controls;
  • backups and recovery procedures where appropriate;
  • supplier selection and contractual protections;
  • removal of access when a project or relationship ends.

No internet transmission or storage system can be guaranteed to be completely secure. If you believe information relating to you may have been compromised, contact Cape Wired promptly.

13

Your data-protection rights

Depending on the circumstances and applicable law, you may have the following rights.

Access

Ask whether Cape Wired holds personal information about you and request a copy of it.

Correction

Ask for inaccurate information to be corrected or incomplete information to be completed.

Erasure

Ask for personal information to be deleted where there is no continuing lawful reason to retain it.

Restriction

Ask for the use of information to be limited in certain circumstances.

Objection

Object to certain processing based on legitimate interests. You may object to direct marketing at any time.

Portability

Request certain information in a structured, machine-readable format where the legal conditions apply.

Withdraw consent

Withdraw consent at any time where consent is the lawful basis. This does not affect earlier lawful processing.

Complain

Raise a concern with Cape Wired or complain to the Information Commissioner’s Office.

Rights are not absolute and may be limited by legal exemptions. Cape Wired may request information needed to confirm your identity and understand the scope of a request.

Cape Wired will normally respond without undue delay and within one month. A longer period may be permitted for complex or multiple requests, in which case you will be informed.

There is normally no fee for exercising a data-protection right. A reasonable fee may be permitted, or a request may be refused, where it is manifestly unfounded or excessive.

14

Questions and complaints

Please contact Cape Wired first if you have a question or concern about the use of your personal information. This provides an opportunity to investigate and resolve the issue directly.

You also have the right to complain to the UK supervisory authority:
